1. General
All services provided by the online shop to the customer are exclusively based on the following General Terms and Conditions. Deviating provisions shall only apply if agreed upon in writing between the online shop and the customer.
2. Conclusion of contract
Only persons who have reached the age of 18 and who are not legally competent at the time of conclusion of the contract are authorized to conclude a contract with the online shop. The online shop's offers constitute a non-binding offer to the customer to order goods from the online shop. By ordering goods from the online shop, the customer implicitly makes a binding offer to conclude a purchase contract. The online shop is entitled to accept this offer within 14 calendar days by sending an order confirmation. The order confirmation will be sent by email, but no later than upon delivery of the goods. If the 14-day period expires without a response, the offer is deemed rejected.
3. Delivery times
All items will be shipped immediately, provided they are available from stock and only while supplies last. If an item is unavailable at short notice, we will inform you by email about the expected delivery time, provided we have your address. Some items have a longer delivery time. In the event of delivery delays, such as those caused by force majeure, traffic disruptions, government orders, or other events beyond the control of the online shop, no claims for damages can be made against the online shop. If delivery is delayed or failed due to the fault of sub-suppliers (impossibility), the online shop is not liable for this.
4. Packaging and shipping
Express deliveries can also be arranged upon customer request. Any additional costs incurred will be borne by the customer. Transport insurance will be purchased at the customer's expense. Any transport damage must be reported to the delivery company immediately.
5. Prices and payment
5.1 All prices quoted are final prices and include the statutory value added tax of currently 20%.
5.2 The final prices do not include the costs for packaging and shipping.
5.3 Due to the constant updating of the online shop's website, any previously provided information regarding price and quality of the goods shall no longer be valid. Errors and misprints excepted.
5.4 The price shown at the time the customer submits the offer shall be decisive for invoicing.
5.5 Payment for goods is made by invoice. Exceptions to this are only valid if agreed upon in writing between the online shop and the customer.
5.6 The customer is obliged to pay the invoice amount within 14 days of receipt of the goods.
5.7 If the customer fails to meet his payment obligation after the expiry of the period specified in paragraph 6, the online shop reserves the right to charge the customer any additional reminder and processing fees resulting therefrom.
5.8 If the customer defaults on payment, the online shop is entitled to charge default interest at the statutory rate. The online shop's right to assert further claims for damages remains unaffected.
6. Retention of title
The ordered goods remain the property of the online shop until full payment is received (retention of title). In the event of default by the customer, the online shop is entitled to take back the goods. This does not constitute a withdrawal from the contract unless expressly stated otherwise.
7. Warranty
7.1 The customer’s claims against the online shop based on a defect in the goods are governed by the statutory provisions.
7.2 The customer undertakes to inspect the goods for any defects upon receipt and to notify the online shop immediately upon discovery of any such defects. Should the customer later discover that the goods are defective, they are obligated to notify the online shop immediately upon discovery. If the customer fails to report a defect, the goods will be deemed accepted.
7.3. Damage caused by the customer through improper handling or handling contrary to the contract shall not be considered a defect in the goods. The manufacturer's specifications shall be decisive for determining improper handling and non-conformity.
7.4. The warranty period is two years. It begins upon receipt of the goods.
7.5. The warranty shall be void in any event of any intervention, repair or attempted repair by the purchaser or unauthorized third parties.
8. Limitation of liability
Unless otherwise stated below, any further claims by the customer, regardless of the legal grounds, are excluded. The online shop is therefore not liable for damages not caused to the delivered item itself; in particular, the online shop is not liable for lost profits or other financial losses suffered by the customer. To the extent that the online shop's contractual liability is excluded or limited, this also applies to the personal liability of employees, representatives, and vicarious agents.
The above limitation of liability shall not apply if the cause of the damage is based on intent or gross negligence, or if personal injury occurs. It shall also not apply if the customer asserts statutory claims.
The provisions of the Product Liability Act remain unaffected. If the online shop negligently breaches a material contractual obligation, liability for property damage is limited to the typical damage.
If the subsequent performance is carried out by way of replacement delivery, the purchaser is obliged to return the initially delivered goods to the online shop within 30 days at the online shop's expense.
The return of defective goods must be made in accordance with legal regulations. The online shop reserves the right to claim damages under the legally stipulated conditions.
The limitation period is two years. It begins upon delivery of the item.
9. Data protection
The customer agrees that his or her personal data, provided to the online shop within the scope of the business relationship, may be stored and processed electronically. It is pointed out that data collected within the meaning of this provision will be collected and processed exclusively for the purposes of providing services, in particular for order processing and accounting purposes. The online shop does not share customer data with third parties.
10. Copyright
All third-party logos, images, and graphics displayed are the property of their respective companies and are subject to the copyright of their respective licensors. All photos, logos, texts, reports, scripts, and programming routines displayed on these pages that are our own developments or have been prepared by us may not be copied or used in any other way without our permission. All rights reserved.
11. Place of jurisdiction
11.1 Unless otherwise provided by law, the place of jurisdiction shall be the registered office of the online shop.
11.2 All disputes arising from this legal relationship shall be governed by Austrian law, excluding its conflict of law provisions. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
12. Validity of the General Terms and Conditions
By placing an order, the customer accepts the online shop's General Terms and Conditions. Should any provision of these General Terms and Conditions be invalid for any reason, the validity of the remaining provisions shall remain unaffected. Verbal agreements require written confirmation to be valid.
